1. Agreement to Terms
By accessing or using CronGuard ("the Service"), operated by FreelyIT ("we", "our", or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service. These Terms apply to all users, including visitors, registered users, and paying subscribers.
2. Description of Service
CronGuard is a cron job monitoring service that allows you to monitor scheduled tasks by receiving HTTP pings. The Service alerts you when your scheduled jobs fail to run or run late. Features and functionality may vary based on your subscription plan.
3. Account Registration
To use certain features of the Service, you must create an account. When creating an account, you agree to:
- Provide accurate, current, and complete information
- Maintain and promptly update your account information
- Keep your login credentials secure and confidential
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized access or security breach
We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.
4. Subscription Plans and Payment
4.1 Plans
CronGuard offers multiple subscription tiers: Free, Pro, and Team. Each plan has different features, monitor limits, and data retention periods as described on our pricing page.
4.2 Billing
Paid subscriptions are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law or as explicitly stated in these Terms. Prices are subject to change with 30 days' notice.
4.3 Automatic Renewal
Subscriptions automatically renew unless cancelled before the renewal date. You can cancel your subscription at any time through your account settings or the Stripe billing portal.
4.4 Downgrade Policy
When downgrading to a lower-tier plan, you may need to reduce your monitors to comply with the new plan's limits. Features and data retention will adjust according to the new plan at the start of the next billing cycle.
5. Acceptable Use
You agree to use CronGuard only for lawful purposes. You may not:
- Use the Service to monitor illegal activities or content
- Attempt to gain unauthorized access to the Service or its systems
- Interfere with or disrupt the Service or servers
- Circumvent rate limits or abuse the ping endpoints
- Use automated tools to scrape or extract data from the Service
- Resell, redistribute, or provide access to the Service to third parties without authorization
- Upload malicious code, viruses, or harmful content
- Violate any applicable laws or regulations
- Harass, abuse, or harm other users
6. Rate Limits
To ensure fair usage and service stability, ping endpoints are subject to rate limiting (5 requests per minute per monitor). Excessive requests may result in temporary blocking. Continued abuse may result in account suspension.
7. Service Availability and Support
7.1 Availability
We strive to maintain high availability of the Service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.
7.2 Support
Support is provided via email. Response times may vary based on your subscription plan and the nature of your inquiry. We are not obligated to provide 24/7 support unless explicitly included in your plan.
8. Intellectual Property
The Service, including its design, code, features, and content, is owned by FreelyIT and protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our explicit written permission. The CronGuard name and logo are trademarks of FreelyIT.
9. Your Data
You retain ownership of any data you submit to the Service. By using the Service, you grant us a limited license to store, process, and display your data solely for the purpose of providing the Service. We will handle your data in accordance with our Privacy Policy.
10. Third-Party Services
CronGuard integrates with third-party services including Clerk (authentication), Stripe (payments), Resend (email), and Neon (database). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the availability, security, or practices of third-party services.
11. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE. YOU USE THE SERVICE AT YOUR OWN RISK.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FREELYIT AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
13. Indemnification
You agree to indemnify, defend, and hold harmless FreelyIT and its affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.
14. Termination
You may terminate your account at any time by contacting us or through your account settings. We may suspend or terminate your account immediately, without prior notice, if you:
- Violate these Terms or any applicable laws
- Engage in fraudulent or abusive behavior
- Fail to pay for a paid subscription
- Have not used the Service for an extended period (inactive accounts)
Upon termination, your right to use the Service ceases immediately. We may retain certain data as required by law or for legitimate business purposes.
15. Changes to Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated via email or through the Service with at least 30 days' notice. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Service and cancel your account.
16. Governing Law and Disputes
These Terms are governed by and construed in accordance with the laws of the Netherlands. Any disputes arising from these Terms or the Service shall be resolved through the competent courts in the Netherlands. Before initiating legal action, you agree to attempt to resolve disputes informally by contacting us.
17. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
18. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and FreelyIT regarding the Service and supersede all prior agreements, representations, and understandings.
